1. Scope of Services
Kubero Estimating Services provides specialized material quantity takeoffs, digital drawing measurements, and pre-bid plan review for commercial and residential drywall, acoustical ceiling, and metal framing subcontractors.
2. Contractor's Sole Responsibility for Bidding & Pricing
Kubero provides quantity calculations based on provided architectural and structural drawings. The contractor retains complete, independent authority and sole responsibility for:
- Determining unit prices, material purchase discounts, sales tax, and freight allowances.
- Setting crew labor productivity rates, wage burdens, overtime factors, and equipment costs.
- Applying profit margins, overhead percentages, and contingency allowances.
- Submitting final bids, signed subcontracts, and formal proposals to general contractors or project owners.
3. Drawing Assumptions & Discrepancies
Measurements are performed using the drawing revisions provided at the time of engagement. When drawings contain missing details, conflicting scale notes, or unrated partition ambiguities, Kubero documents these assumptions in the deliverable Scope Notes tab. The contractor is responsible for reviewing these notes prior to tender submission.
4. Proposals, Turnaround & Payment Terms
All takeoffs are executed pursuant to a written proposal confirming scope, fee, and guaranteed delivery schedule. Invoices are due upon receipt or according to approved trade credit terms. Unlocked deliverable packages are released upon payment or engagement confirmation.
5. Limitation of Liability
Kubero exercises high professional care and multi-sheet scale verification. However, construction estimating inherently involves drawing interpretations and site-specific conditions. In no event shall Kubero’s liability exceed the total fee paid for the specific takeoff engagement in question.
6. Governing Law
These terms are governed by the laws of the State of Texas, with venue in Harris County, Texas.
